Code § 39-30-03","heading":"Seizure of equipment","body":"1.Any tool, implement, or instrumentality, including a motor vehicle or motor vehicle part, used or possessed in connection with any violation of section 39-30-02 may be seized by a member of a state or local law enforcement agency upon process issued by any court of competent jurisdiction.\n2.Seizure of property described in subsection 1 may be made by a member of a state or local law enforcement agency without process:\na.If in accordance with any applicable law or regulation;\nb.If the seizure is incident to inspection under an administrative inspection warrant;\nc.If the seizure is incident to search made under a search warrant;\nd.If the seizure is incident to a lawful arrest;\ne.If the seizure is made pursuant to a valid consent to search;\nf.If the property seized has been the subject of a prior judgment in favor of the state in a criminal proceeding or in an injunction or forfeiture proceeding under section 39-30-05; or\ng.If there are reasonable grounds to believe that the property is directly or indirectly dangerous to health or safety.\n3.When property is seized under this section, the seizing agency may:\na.Place the property under seal; or\nb.Remove the property to a place selected and designated by the seizing party.","path":["Title 39 Motor Vehicles","Chapter 39-30 Motor Vehicle Chop Shops"],"source_url":"https://ndlegis.gov/cencode/t39c30.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"9b683e62f42bcc9af5225eb8daa92e317013c0b23393aea0b50244bf1cf0fa50","source_id":"us-nd","stale":false,"prev":"us-nd/n.d.-cent.-code-39-30-02","next":"us-nd/n.d.-cent.-code-39-30-04"},"notice":"GroundRules: Original legal text.
