Code § 4.1-38-01","heading":"Risk management program - Anhydrous ammonia","body":"To determine compliance with the risk management program requirements set forth in section 112 of the Clean Air Act of 1990 [42 U.S.C. 7401 et seq.], as amended through June 30, 2011, the agriculture commissioner may:\n1.Request information from any person that:\na.Sells, stores, or handles anhydrous ammonia for agricultural purposes; and\nb.Is required to comply with the risk management program requirements;\n2.Conduct inspections of any person that:\na.Sells, stores, or handles anhydrous ammonia for agricultural purposes; and\nb.Is required to comply with the risk management program requirements; and\n3.Obtain and review risk management plans required under 40 Code of Federal Regulations, part 68, as amended through June 30, 2011, and other records applicable to any person that:\na.Sells, stores, or handles anhydrous ammonia for agricultural purposes; and\nb.Is required to comply with the risk management program requirements.","path":["Title 4.1 Agriculture","Chapter 4.1-38 Anhydrous Ammonia Risk Management"],"source_url":"https://ndlegis.gov/cencode/t04-1c38.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"3dff9123407264eb6ae9114e5692ad78614c26a2338f5ea5a40fc344ef3a5206","source_id":"us-nd","stale":false,"prev":"us-nd/n.d.-cent.-code-4.1-37-16","next":"us-nd/n.d.-cent.-code-4.1-38-02"},"notice":"GroundRules: Original legal text.
