Code § 41-02.1-21","heading":"(2A-212) Implied warranty of merchantability","body":"1.Except in a finance lease, a warranty that the goods will be merchantable is implied in a lease contract if the lessor is a merchant with respect to goods of that kind.\n2.Goods to be merchantable must:\na.Pass without objection in the trade under the description in the lease agreement;\nb.In the case of fungible goods, be of fair average quality within the description;\nc.Be fit for the ordinary purposes for which goods of that type are used;\nd.Run, within the variation permitted by the lease agreement, of even kind, quality, and quantity within each unit and among all units involved;\ne.Be adequately contained, packaged, and labeled as the lease agreement may require; and\nf.Conform to any promises or affirmations of fact made on the container or label.\n3.Other implied warranties may arise from course of dealing or usage of trade.","path":["Title 41 Uniform Commercial Code","Chapter 41-02.1 Leases"],"source_url":"https://ndlegis.gov/cencode/t41c02-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"f0afe3f25c6f6afd7f42fe70247b959c90dfacee1a3904c54a2ba8d1b1224a3e","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-41-02.1-20","next":"us-nd/n.d.-cent.-code-41-02.1-22"},"notice":"GroundRules: Original legal text.
