Code § 41-09-110","heading":"(9-613) Contents and form of notification before disposition of collateral - General","body":"1.The contents of a notification of disposition are sufficient if the notification:\na.Describes the debtor and the secured party;\nb.Describes the collateral that is the subject of the intended disposition;\nc.States the method of intended disposition;\nd.States that the debtor is entitled to an accounting of the unpaid indebtedness and states the charge, if any, for an accounting; and\ne.States the time and place of a public disposition or the time after which any other disposition is to be made.\n2.Whether the contents of a notification that lacks any of the information specified in subsection 1 are nevertheless sufficient is a question of fact.\n3.The contents of a notification providing substantially the information specified in subsection 1 are sufficient, even if the notification includes:\na.Information not specified by that subsection; or\nb.Minor errors that are not seriously misleading.\n4.A particular phrasing of the notification is not required.","path":["Title 41 Uniform Commercial Code","Chapter 41-09 Secured Transactions"],"source_url":"https://ndlegis.gov/cencode/t41c09.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"29f1297305d2426cfcc07c316e1db0a98740ccec005d45d40547f8780487b32e","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-41-09-109","next":"us-nd/n.d.-cent.-code-41-09-111"},"notice":"GroundRules: Original legal text.
