Code § 41-09-29","heading":"(9-309) Security interest perfected upon attachment","body":"The following security interests are perfected when they attach:\n1.A purchase-money security interest in consumer goods, except as otherwise provided in subsection 2 of section 41-09-31 with respect to consumer goods that are subject to a statute or treaty described in subsection 1 of section 41-09-31;\n2.An assignment of accounts or payment intangibles which does not by itself or in conjunction with other assignments to the same assignee transfer a significant part of the assignor's outstanding accounts or payment intangibles;\n3.A sale of a payment intangible;\n4.A sale of a promissory note;\n5.A security interest created by the assignment of a health care insurance receivable to the provider of the health care goods or services;\n6.A security interest arising under section 41-02-46, section 41-02-53, subsection 3 of section 41-02-90, or subsection 5 of section 41-02.1-56, until the debtor obtains possession of the collateral;\n7.A security interest of a collecting bank arising under section 41-04-22;\n8.A security interest of an issuer or nominated person arising under section 41-05-18;\n9.A security interest arising in the delivery of a financial asset under subsection 3 of section 41-09-16;\n10.A security interest in investment property created by a broker or securities intermediary;\n11.A security interest in a commodity contract or a commodity account created by a commodity intermediary;\n12.An assignment for the benefit of all creditors of the transferor and subsequent transfers by the assignee thereunder;\n13.A security interest created by an assignment of a beneficial interest in a decedent's estate; and\n14.A sale by an individual of an account that is a right to payment of winnings in a lottery or other game of chance.","path":["Title 41 Uniform Commercial Code","Chapter 41-09 Secured Transactions"],"source_url":"https://ndlegis.gov/cencode/t41c09.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"3aee7e669f4b5884b9c1ec5bfa2e56bd3f5eeaa355956b019700230976f42580","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-41-09-28","next":"us-nd/n.d.-cent.-code-41-09-30"},"notice":"GroundRules: Original legal text.
