Code § 41-09-47","heading":"(9-327) Priority of security interests in deposit account and uncertificated certificate of deposit","body":"The following rules govern priority among conflicting security interests in the same deposit account or uncertificated certificate of deposit:\n1.A security interest held by a secured party having control of the deposit account or uncertificated certificate of deposit under section 41-09-04 has priority over a conflicting security interest held by a secured party that does not have control.\n2.Except as otherwise provided in subsections 3 and 4, security interests perfected by control under section 41-09-34 rank according to priority in time of obtaining control.\n3.Except as otherwise provided in subsection 4, a security interest held by the bank with which the deposit account or uncertificated certificate of deposit is maintained has priority over a conflicting security interest held by another secured party.\n4.A security interest perfected by control under subdivision c of subsection 1 of section 41-09-04 has priority over a security interest held by the bank with which the deposit account or uncertificated certificate of deposit is maintained.","path":["Title 41 Uniform Commercial Code","Chapter 41-09 Secured Transactions"],"source_url":"https://ndlegis.gov/cencode/t41c09.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"880e8757a14e0aa037e40154fb0aede0e0e5fefb3958eb57f33f718ebd8341d0","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-41-09-46.1","next":"us-nd/n.d.-cent.-code-41-09-48"},"notice":"GroundRules: Original legal text.
