Code § 43-02.2-06.1","heading":"Permit to practice - Firm wholly owned by qualified plan","body":"1.A firm may be wholly owned by a qualified plan as described and defined in sections 401(a) and 4975(e)(7) of the Internal Revenue Code [26 U.S.C. 401(a) and 4975(e)\n(7)], including an employee stock ownership plan, if an applicant for initial issuance or renewal of a permit to practice shows:\na.Fifty-one percent or more of the beneficial ownership of the plan belongs to certified public accountants or licensed public accountants of the state or other recognized jurisdiction;\nb.All certified public accountants or licensed public accountants associated with the firm whose principal place of business is in this state and who perform professional services in this state hold a valid certificate or license issued by this state; and\nc.A simple majority of the board of directors of the firm are certified public accountants or licensed public accountants of the state or other recognized jurisdiction.","path":["Title 43 Occupations And Professions","Chapter 43-02.2 Accountants"],"source_url":"https://ndlegis.gov/cencode/t43c02-2.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"63208e2a534a412f3c2e641b04325a7b5f13b7188c724e1def230b7b4cf60b76","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-43-02.2-06","next":"us-nd/n.d.-cent.-code-43-02.2-07"},"notice":"GroundRules: Original legal text.
