Code § 44-04-30","heading":"Records of the state fire marshal, fire departments, and rural fire protection districts confidential","body":"1.a.An investigation record of the state fire marshal, a fire department, or a rural fire protection district is confidential until the investigation:\n(1)Is closed and not referred for further criminal investigation or prosecution; or\n(2)The criminal investigation is no longer active under section 44-04-18.7.\nb.This subsection does not restrict the release of the name and identifiable biographical information of a child under section 12.1-35-03.\n2.Standard operating procedures written for emergency response, prefire action plans, plans of a building, pipeline, electrical system, or any other infrastructure plan in the possession of the state fire marshal, a fire department, or rural fire protection district are exempt from section 44-04-18.\n3.Individually identifiable health information obtained by the state fire marshal, a fire department, or a rural fire protection district is confidential.\n4.An image of a victim of a fire is an exempt record.","path":["Title 44 Offices And Officers","Chapter 44-04 Duties, Records, And Meetings"],"source_url":"https://ndlegis.gov/cencode/t44c04.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"41381e89caaf2c34dce2b8d5fb12c52dfb81520d3a94ee09a8e1d589bae68d2e","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-44-04-29","next":"us-nd/n.d.-cent.-code-44-04-31"},"notice":"GroundRules: Original legal text.
