Code § 47-24.1-06","heading":"Other transfer by fiduciary","body":"1.Subject to subsection 3, a personal representative or trustee may make an irrevocable transfer to another adult or trust company as custodian for the benefit of a minor pursuant to section 47-24.1-09, in the absence of a will or under a will or trust that does not contain an authorization to do so.\n2.Subject to subsection 3, a conservator may make an irrevocable transfer to another adult or trust company as custodian for the benefit of the minor pursuant to section 47-24.1-09.\n3.A transfer under subsection 1 or 2 may be made only if:\na.The personal representative, trustee, or conservator considers the transfer to be in the best interest of the minor;\nb.The transfer is not prohibited by or inconsistent with provisions of the applicable will, trust agreement, or other governing instrument; and\nc.The transfer is authorized by the court if it exceeds ten thousand dollars in value.","path":["Title 47 Property","Chapter 47-24.1 Uniform Transfers To Minors Act"],"source_url":"https://ndlegis.gov/cencode/t47c24-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"09a831603004ebebb04a9de502924cede836b78fadc77c501f3cf0ab18751a5d","source_id":"us-nd","stale":false,"prev":"us-nd/n.d.-cent.-code-47-24.1-05","next":"us-nd/n.d.-cent.-code-47-24.1-07"},"notice":"GroundRules: Original legal text.
