Code § 47-36-08","heading":"Disclosure of content of electronic communications of principal","body":"To the extent a power of attorney expressly grants an agent authority over the content of electronic communications sent or received by the principal and unless directed otherwise by the principal or the court, a custodian shall disclose to the agent the content if the agent gives the custodian:\n1.A written request for disclosure in physical or electronic form;\n2.An original or copy of the power of attorney expressly granting the agent authority over the content of electronic communications of the principal;\n3.A certification by the agent, under penalty of perjury, that the power of attorney is in effect; and\n4.If requested by the custodian:\na.A number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the principal's account; or\nb.Evidence linking the account to the principal.","path":["Title 47 Property","Chapter 47-36 Uniform Fiduciary Access To Digital Assets Act"],"source_url":"https://ndlegis.gov/cencode/t47c36.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"810d62e6e625c2d2556c37ac32dd6b7d33f6089293cc008949074c53f66ab378","source_id":"us-nd","stale":false,"prev":"us-nd/n.d.-cent.-code-47-36-07","next":"us-nd/n.d.-cent.-code-47-36-09"},"notice":"GroundRules: Original legal text.
