Code § 51-21-03","heading":"Detention of suspect - Procedure","body":"Any peace officer or merchant who reasonably believes that a person has committed, or is in the process of committing, theft may detain such person, on or off the premises of a retail mercantile establishment, in a reasonable manner and for a reasonable length of time for all or any of the following purposes:\n1.To require the person to identify oneself.\n2.To verify such identification.\n3.To determine whether such person has in the person's possession unpurchased merchandise and, if so, to recover such merchandise.\n4.To inform a peace officer of the detention of the person and surrender custody of that person to a peace officer.\n5.In the case of a minor, to inform a peace officer, the parents, guardian, or other private person interested in the welfare of that minor of this detention and to surrender custody of said minor to the person informed.","path":["Title 51 Sales And Exchanges","Chapter 51-21 Retail Theft Act"],"source_url":"https://ndlegis.gov/cencode/t51c21.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"cc4380773fdbdff54addd43a185c1f0f43595c388d9cc0d76e53cecda96eeb69","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-51-21-02","next":"us-nd/n.d.-cent.-code-51-21-04"},"notice":"GroundRules: Original legal text.
