(Retroactive application - See note)","body":"1.The human resource management services division of the office of management and budget shall establish a state leave sharing program for permanent employees of the state. The program must provide for a mechanism for state employees to donate accrued annual and sick leave to an employee who does not have available leave who is suffering from a severe, extreme, or life-threatening condition, or who is caring for an immediate relative or household member who is suffering from a severe, extreme, or life-threatening condition.\n2.A temporary employee or contracted employee with a limited-term appointment is not eligible to participate in the leave sharing program. An employee may not use more than four months donated leave in any twelve-month period and an employee may not retain leave beyond the occurrence necessitating the leave.\n3.The human resource management services division shall:\na.Require medical certification from a physician, physician assistant, psychologist, or advanced practice nurse practitioner verifying the medical condition and the expected duration of the condition;\nb.Track the amount of leave taken by permanent state employees under the program; and\nc.Adopt rules in accordance with chapter 28-32 to implement this section.","path":["Title 54 State Government","Chapter 54-06 General Provisions"],"source_url":"https://ndlegis.gov/cencode/t54c06.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"4ce00158341331e2ffa2a89a2b4b5db32422eeefc8c81d6c9876b4640da7ff42","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-54-06-14.6","next":"us-nd/n.d.-cent.-code-54-06-15"},"notice":"GroundRules: Original legal text.
