Code § 54-40.5-03","heading":"Transfer of powers or functions to the county","body":"A political subdivision may enter into an agreement for the transfer of the legal, administrative, and financial responsibilities for carrying out a power or function of the political subdivision as required or permitted by law or home rule charter. The agreement must include:\n1.The nature of the power or function to be transferred;\n2.The effective date of the proposed transfer;\n3.The responsibility for administration of the power or function to be transferred;\n4.The manner in which affected employees currently engaged in the performance of the power or function will be transferred, reassigned, or otherwise treated;\n5.The manner in which real property, facilities, equipment, or other personal property required in the exercise of the power or function are to be transferred, sold, or otherwise disposed of;\n6.The method of financing, establishing, and maintaining a budget for the power or function; and\n7.Other legal, financial, and administrative arrangements necessary to affect the transfer in an orderly and equitable manner.","path":["Title 54 State Government","Chapter 54-40.5 Local Government Powers Transfer"],"source_url":"https://ndlegis.gov/cencode/t54c40-5.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"0b4f6b6734971b28674fc796469f9bfa35a62bfd072fb9ab12651eb2eac1963d","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-54-40.5-02","next":"us-nd/n.d.-cent.-code-54-40.5-04"},"notice":"GroundRules: Original legal text.
