Code § 59-18-12","heading":"(1012) Protection of person dealing with trustee","body":"1.A person other than a beneficiary who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers, is protected from liability as if the trustee properly exercised the power.\n2.A person other than a beneficiary who in good faith deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of their exercise.\n3.A person who in good faith delivers assets to a trustee need not ensure their proper application.\n4.A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated, is protected from liability as if the former trustee were still a trustee.\n5.Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["Title 59 Trusts","Chapter 59-18 Trustee Liability And Dealings"],"source_url":"https://ndlegis.gov/cencode/t59c18.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"900b830db945f5335e13c6ce52c548d5164b6d33f5749ce453642a2fe7bb1161","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-59-18-11","next":"us-nd/n.d.-cent.-code-59-18-13"},"notice":"GroundRules: Original legal text.
