Stat. § 2-2650","body":"Whenever a violation of the Pesticide Act has occurred, the following shall be considered when determining the severity or amount of any administrative or civil fine, the issuance of a cease and desist order, or the disposition of any license:\n\n(1) The culpability and good faith of and any past violations by such person;\n\n(2) The seriousness of the violation, including the amount of any actual or potential risk to human health or environment; and\n\n(3) The extent to which the person derived financial gain as a result of permitting or committing the violation, including a determination of the size of the company itself and the impact on it.","path":["NE Code","Chapter 2"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=2-2650","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"43beea7264163a658664e7a1735b1c4c3f16c08e0cebd76d3e09e93d85dd591a","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-2-265","next":"us-ne/neb.-rev.-stat.-2-2651"},"notice":"GroundRules: Original legal text.
