Stat. § 25-3504","body":"(a) In this section:\n\n(1) Child means an unemancipated individual who is less than nineteen years of age.\n\n(2) Parent means an individual recognized as a parent under law of this state other than the Uniform Civil Remedies for Unauthorized Disclosure of Intimate Images Act.\n\n(b) A person is not liable under the act if the person proves that disclosure of, or a threat to disclose, an intimate image was:\n\n(1) made in good faith in:\n\n(A) law enforcement;\n\n(B) a legal proceeding; or\n\n(C) medical education or treatment;\n\n(2) made in good faith in the reporting or investigation of:\n\n(A) unlawful conduct; or\n\n(B) unsolicited and unwelcome conduct;\n\n(3) related to a matter of public concern or public interest; or\n\n(4) reasonably intended to assist the depicted individual.\n\n(c) Subject to subsection (d) of this section, a defendant who is a parent, legal guardian, or individual with legal custody of a child is not liable under the act for a disclosure or threatened disclosure of an intimate image, as defined in subdivision (7)(A) of section 25-3502 , of the child.\n\n(d) If a defendant asserts an exception to liability under subsection (c) of this section, the exception does not apply if the plaintiff proves the disclosure was:\n\n(1) prohibited by law other than the act; or\n\n(2) made for the purpose of sexual arousal, sexual gratification, humiliation, degradation, or monetary or commercial gain.\n\n(e) Disclosure of, or a threat to disclose, an intimate image is not a matter of public concern or public interest solely because the depicted individual is a public figure.","path":["NE Code","Chapter 25"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=25-3504","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"ed057925ebfc38cb27ed9cc1b36a010057cc0336a3762443535c54daf1f30d99","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-25-3503","next":"us-ne/neb.-rev.-stat.-25-3505"},"notice":"GroundRules: Original legal text.
