Stat. § 28-309","body":"(1) A person commits the offense of assault in the second degree if he or she:\n\n(a) Intentionally or knowingly causes bodily injury to another person with a dangerous instrument;\n\n(b) Recklessly causes serious bodily injury to another person with a dangerous instrument; or\n\n(c) Unlawfully strikes or wounds another (i) while legally confined in a jail or an adult correctional or penal institution, (ii) while otherwise in legal custody of the Department of Correctional Services, or (iii) while committed as a dangerous sex offender under the Sex Offender Commitment Act.\n\n(2) Assault in the second degree shall be a Class IIA felony.","path":["NE Code","Chapter 28"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=28-309","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"f2e23c00e1ab211fd41c8270c22a2a7930084ba4f2b3f86a71addb32de29b22a","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-28-308","next":"us-ne/neb.-rev.-stat.-28-310"},"notice":"GroundRules: Original legal text.
