Stat. § 28-310.01","body":"(1) A person commits the offense of assault by strangulation or suffocation if the person knowingly and intentionally:\n\n(a) Impedes the normal breathing or circulation of the blood of another person by applying pressure on the throat or neck of the other person; or\n\n(b) Impedes the normal breathing of another person by covering the mouth and nose of the person.\n\n(2) An offense is committed under this section regardless of whether a visible injury resulted.\n\n(3) Except as provided in subsection (4) of this section, a violation of this section is a Class IIIA felony.\n\n(4) A violation of this section is a Class IIA felony if:\n\n(a) The person used or attempted to use a dangerous instrument while committing the offense;\n\n(b) The person caused serious bodily injury to the other person while committing the offense; or\n\n(c) The person has been previously convicted of a violation of this section.\n\n(5) It is an affirmative defense that an act constituting strangulation or suffocation was the result of a legitimate medical procedure.","path":["NE Code","Chapter 28"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=28-310.01","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"ea425299b0c10594c27d0a3a2efff8cee55158255c2eb968eb4e95e99319ef70","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-28-310","next":"us-ne/neb.-rev.-stat.-28-311"},"notice":"GroundRules: Original legal text.
