Stat. § 29-2322","body":"If the appeal has been properly filed, as set forth in section 29-2321 , the appellate court, upon a review of the record, shall determine whether the sentence imposed is excessively lenient, having regard for:\n\n(1) The nature and circumstances of the offense;\n\n(2) The history and characteristics of the defendant;\n\n(3) The need for the sentence imposed:\n\n(a) To afford adequate deterrence to criminal conduct;\n\n(b) To protect the public from further crimes of the defendant;\n\n(c) To reflect the seriousness of the offense, to promote respect for the law, and to provide just punishment for the offense; and\n\n(d) To provide the defendant with needed educational or vocational training, medical care, or other correctional treatment in the most effective manner; and\n\n(4) Any other matters appearing in the record which the appellate court deems pertinent.","path":["NE Code","Chapter 29"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=29-2322","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"11ff046c242883984d0dd71d6cd1bfdeec0c0b1bc73e1288f3b2888049d40724","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-29-2321","next":"us-ne/neb.-rev.-stat.-29-2323"},"notice":"GroundRules: Original legal text.
