Stat. § 30-3847","body":"(UTC 502) (a) A spendthrift provision is valid only if it restrains both voluntary and involuntary transfer of a beneficiary's interest.\n\n(b) A term of a trust providing that the interest of a beneficiary is held subject to a \"spendthrift trust\", or words of similar import, is sufficient to restrain both voluntary and involuntary transfer of the beneficiary's interest.\n\n(c) A beneficiary may not transfer an interest in a trust in violation of a valid spendthrift provision and, except as otherwise provided in sections 30-3846 to 30-3852 , a creditor or assignee of the beneficiary may not reach the interest or a distribution by the trustee before its receipt by the beneficiary.","path":["NE Code","Chapter 30"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=30-3847","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"dd808ecbd0f26323c059d21dfc3d1789623cbce67f267fa266b00d7124cbe118","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-30-3846","next":"us-ne/neb.-rev.-stat.-30-3848"},"notice":"GroundRules: Original legal text.
