Stat. § 30-3897","body":"(UTC 1008) (a) A term of a trust relieving a trustee of liability for breach of trust is unenforceable to the extent that it:\n\n(1) relieves the trustee of liability for breach of trust committed in bad faith or with reckless indifference to the purposes of the trust or the interests of the beneficiaries; or\n\n(2) was inserted as the result of an abuse by the trustee of a fiduciary or confidential relationship to the settlor.\n\n(b) An exculpatory term drafted or caused to be drafted by the trustee is invalid as an abuse of a fiduciary or confidential relationship unless the trustee proves that the exculpatory term is fair under the circumstances and that its existence and contents were adequately communicated to the settlor.","path":["NE Code","Chapter 30"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=30-3897","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"afb9976f44e20fd703b41c0c92f105483c002c29d907c06e41385ce856f11575","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-30-3896","next":"us-ne/neb.-rev.-stat.-30-3898"},"notice":"GroundRules: Original legal text.
