Stat. § 30-4517","body":"(a) Except as otherwise provided in this section, a second-trust instrument may not relieve an authorized fiduciary from liability for breach of trust to a greater extent than the first-trust instrument.\n\n(b) A second-trust instrument may provide for indemnification of an authorized fiduciary of the first trust or another person acting in a fiduciary capacity under the first trust for any liability or claim that would have been payable from the first trust if the decanting power had not been exercised.\n\n(c) A second-trust instrument may not reduce fiduciary liability in the aggregate.\n\n(d) Subject to subsection (c) of this section, a second-trust instrument may divide and reallocate fiduciary powers among fiduciaries, including one or more trustees, distribution advisors, investment advisors, trust protectors, or other persons, and relieve a fiduciary from liability for an act or failure to act of another fiduciary as permitted by law of this state other than the Uniform Trust Decanting Act.","path":["NE Code","Chapter 30"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=30-4517","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"4323406cba9bfb8d810adf2d65474c30b9cae8a4a04e3eb8dfcf3c65fad462d1","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-30-4516","next":"us-ne/neb.-rev.-stat.-30-4518"},"notice":"GroundRules: Original legal text.
