Stat. § 30-4605","body":"(a) A power of appointment is created only if:\n\n(1) the instrument creating the power:\n\n(A) is valid under applicable law; and\n\n(B) except as otherwise provided in subsection (b) of this section, transfers the appointive property; and\n\n(2) the terms of the instrument creating the power manifest the donor's intent to create in a powerholder a power of appointment over the appointive property exercisable in favor of a permissible appointee.\n\n(b) Subdivision (a)(1)(B) of this section does not apply to the creation of a power of appointment by the exercise of a power of appointment.\n\n(c) A power of appointment may not be created in a deceased individual.\n\n(d) Subject to an applicable rule against perpetuities, a power of appointment may be created in an unborn or unascertained powerholder.","path":["NE Code","Chapter 30"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=30-4605","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"309efd82556b4473fcb2f4b967e13404963ccdd9dd1a6113b4393dfa41c244db","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-30-4604","next":"us-ne/neb.-rev.-stat.-30-4606"},"notice":"GroundRules: Original legal text.
