Stat. § 30-4707","body":"(a) At the death of a community-property spouse, the surviving community-property spouse or a personal representative, heir, or nonprobate transferee of the decedent may assert a right based on an act of:\n\n(1) the surviving community-property spouse or decedent during the marriage or other relationship under which community property then could be acquired; or\n\n(2) the decedent that takes effect at the death of the decedent.\n\n(b) In determining a right under subsection (a) of this section and corresponding remedy, the court:\n\n(1) shall apply equitable principles; and\n\n(2) may consider the community property law of the jurisdiction where the decedent or surviving community-property spouse was domiciled when property was acquired or enhanced.","path":["NE Code","Chapter 30"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=30-4707","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"e980b2e02885b50570bd890ee4f52c3a904c5572da8ea4c6da3142564323a5c0","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-30-4706","next":"us-ne/neb.-rev.-stat.-30-4708"},"notice":"GroundRules: Original legal text.
