Stat. § 38-2841","heading":"Prescription drug or device or legend drug or device, defined.","body":"(1) Prescription drug or device or legend drug or device means:\n(a) A drug or device which is required under federal law to be labeled with one of the following statements prior to being dispensed or delivered:\n(i) Caution: Federal law prohibits dispensing without prescription;\n(ii) Caution: Federal law restricts this drug to use by or on the order of a licensed veterinarian; or\n(iii) \"Rx Only\"; or\n(b) A drug or device which is required by any applicable federal or state law to be dispensed pursuant only to a prescription or chart order or which is restricted to use by practitioners only.\n(2) Prescription drug or device or legend drug or device does not include a type of device, including supplies and device components, which carries the federal Food and Drug Administration legend \"Caution: Federal law restricts this device to sale by or on the order of a licensed health care practitioner\" or an alternative legend approved by the federal Food and Drug Administration which it recognizes, in published guidance, as conveying essentially the same message.","path":["Chapter 38 - HEALTH OCCUPATIONS AND PROFESSIONS"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=38-2841","current_through":"Laws 2026","vintage":"","retrieved_at":"2026-10-18T05:58:13Z","sha256":"95bf3deb66af2097be9f68db3baa9efcd53f92df05c4ad0ecf9901c5943eca1f","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-38-2840","next":"us-ne/neb.-rev.-stat.-38-2842"},"notice":"GroundRules: Original legal text.
