Stat. § 42-748.04","body":"(a) In a support proceeding under sections 42-748.01 to 42-748.13 , the Nebraska Department of Health and Human Services shall:\n\n(1) transmit and receive applications; and\n\n(2) initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this state.\n\n(b) The following support proceedings are available to an obligee under the Convention:\n\n(1) recognition or recognition and enforcement of a foreign support order;\n\n(2) enforcement of a support order issued or recognized in this state;\n\n(3) establishment of a support order if there is no existing order, including, if necessary, determination of parentage of a child;\n\n(4) establishment of a support order if recognition of a foreign support order is refused under subdivision (b)(2), (4), or (9) of section 42-748.08 ;\n\n(5) modification of a support order of a tribunal of this state; and\n\n(6) modification of a support order of a tribunal of another state or a foreign country.\n\n(c) The following support proceedings are available under the Convention to an obligor against which there is an existing support order:\n\n(1) recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state;\n\n(2) modification of a support order of a tribunal of this state; and\n\n(3) modification of a support order of a tribunal of another state or a foreign country.\n\n(d) A tribunal of this state may not require security, bond, or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the Convention.","path":["NE Code","Chapter 42"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=42-748.04","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"92e6b7e4054f6e395981ec068ec0335d388772f611ee1c7f9f7ab9669b15d138","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-42-748.03","next":"us-ne/neb.-rev.-stat.-42-748.05"},"notice":"GroundRules: Original legal text.
