Stat. § 43-4705","body":"Each caregiver shall use the reasonable and prudent parent standard in determining whether to give permission for a child to participate in extracurricular, enrichment, cultural, and social activities. When using the reasonable and prudent parent standard, the caregiver shall consider:\n\n(1) The child’s goals and input;\n\n(2) To the extent possible, the input of the parent of the child;\n\n(3) The child’s age, maturity, and developmental level to maintain the overall health and safety of the child;\n\n(4) The potential risk factors and the appropriateness of the extracurricular, enrichment, cultural, or social activity;\n\n(5) The best interests of the child, based on information known by the caregiver;\n\n(6) The importance of encouraging the child’s emotional and developmental growth;\n\n(7) The importance of providing the child with the most family-like living experience possible;\n\n(8) The behavioral history of the child and the child’s ability to safely participate in the proposed activity;\n\n(9) The child’s personal and cultural identity; and\n\n(10) The individualized needs of the child.","path":["NE Code","Chapter 43"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=43-4705","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"085b9de676c749ee17caf22564a9ea28a80370c6d4d912c4343f078bb00a7b5c","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-43-4704","next":"us-ne/neb.-rev.-stat.-43-4706"},"notice":"GroundRules: Original legal text.
