Stat. § 64-105.02","body":"(1) A notary public may certify the affixation of a signature by mark on a document presented for notarization if:\n\n(a) The mark is affixed in the presence of the notary public and of two witnesses unaffected by the document;\n\n(b) Both witnesses sign their own names beside the mark;\n\n(c) The notary public writes below the mark: \"Mark affixed by (name of signer by mark) in presence of (names and addresses of witnesses) and undersigned notary public\"; and\n\n(d) The notary public notarizes the signature by mark through an acknowledgment, jurat, or signature witnessing.\n\n(2) A notary public may sign the name of a person physically unable to sign or make a mark on a document presented for notarization if:\n\n(a) The person directs the notary public to do so in the presence of two witnesses unaffected by the document;\n\n(b) The notary public signs the person's name in the presence of the person and the witnesses;\n\n(c) Both witnesses sign their own names beside the signature;\n\n(d) The notary public writes below the signature: \"Signature affixed by notary public in the presence of (names and addresses of person and two witnesses)\"; and\n\n(e) The notary public notarizes the signature through an acknowledgment, jurat, or signature witnessing.","path":["NE Code","Chapter 64"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=64-105.02","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"5b29d302edea0fd814b2e62c61d3c6abbded410ecd8f383b59605f8b3fc019e9","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-64-105.01","next":"us-ne/neb.-rev.-stat.-64-105.03"},"notice":"GroundRules: Original legal text.
