Stat. § 71-2476","body":"(1) Prescription drug or device or legend drug or device means a drug or device:\n\n(a) Which is required under federal law to be labeled with one of the following statements prior to being dispensed or delivered:\n\n(i) Caution: Federal law prohibits dispensing without prescription;\n\n(ii) Caution: Federal law restricts this drug to use by or on the order of a licensed veterinarian; or\n\n(iii) \"Rx Only\"; or\n\n(b) Which is required by any applicable federal or state law to be dispensed pursuant only to a prescription or chart order or which is restricted to use by practitioners only.\n\n(2) Prescription drug or device or legend drug or device does not include a type of device, including supplies and device components, which carries the federal Food and Drug Administration legend \"Caution: Federal law restricts this device to sale by or on the order of a licensed health care practitioner\" or an alternative legend approved by the federal Food and Drug Administration which it recognizes, in published guidance, as conveying essentially the same message.","path":["NE Code","Chapter 71"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=71-2476","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:21Z","sha256":"c2ae66f73ecb59bce165acf65499932c4fbb1dcfd0dcb5f906b526bca8ffe3db","source_id":"us-ne","stale":false,"prev":"us-ne/neb.-rev.-stat.-71-2475","next":"us-ne/neb.-rev.-stat.-71-2477"},"notice":"GroundRules: Original legal text.
