Stat. § 83-961","heading":"Terms, defined.","body":"For purposes of the Correctional System Overcrowding Emergency Act:\n(1) Board means the Board of Parole;\n(2) Committed offender has the definition found in section 83-170;\n(3) Department means the Department of Correctional Services;\n(4) Design capacity means the total designed bed space in facilities operated by the department, as certified by the director;\n(5) Director means the Director of Correctional Services;\n(6) Operational capacity means one hundred twenty-five percent of design capacity;\n(7) Population means the actual number of inmates assigned to facilities operated by the department and does not include inmates assigned to county-operated correctional institutions; and\n(8) Violent offense means any one or more of the following crimes: Murder in the first degree, murder in the second degree, manslaughter, assault in the first degree, kidnapping, sexual assault in the first degree, or robbery.","path":["Chapter 83 - STATE INSTITUTIONS"],"source_url":"https://nebraskalegislature.gov/laws/statutes.php?statute=83-961","current_through":"Laws 2026","vintage":"","retrieved_at":"2026-09-17T21:01:11Z","sha256":"6cd189540a59b5ff36142c0e6502139390d8f6dda8eb6c1efc74a6c4638de0c0","source_id":"us-ne","stale":true,"prev":"us-ne/neb.-rev.-stat.-83-960","next":"us-ne/neb.-rev.-stat.-83-962"},"notice":"GroundRules: Original legal text.
