A person shall be guilty of a class A misdemeanor if a natural person, or a felony if any other person, who:\n(a) Performs embalming without being licensed under this chapter.\n(b) Makes funeral arrangements, unless such person is a funeral director, next-of-kin as defined in RSA 290:16, IV, or designated agent under RSA 290:17.\nII.
