{"data":{"id":"us-nh/rsa-564-b-10-1001","jurisdiction":"us-nh","citation":"RSA 564-B:10-1001","heading":"Remedies for Breach of Trust","body":"(a) A violation by a trustee of a duty the trustee owes to a beneficiary is a breach of trust.\n(b) To remedy a breach of trust that has occurred or may occur, the court may:\n(1) compel the trustee to perform the trustee's duties;\n(2) enjoin the trustee from committing a breach of trust;\n(3) compel the trustee to redress a breach of trust by paying money, restoring property, or other means;\n(4) order a trustee to account;\n(5) appoint a special fiduciary to take possession of the trust property and administer the trust;\n(6) suspend the trustee;\n(7) remove the trustee as provided in RSA 564-B:7-706;\n(8) reduce or deny compensation to the trustee;\n(9) subject to RSA 564-B:10-1012, void an act of the trustee, impose a lien or a constructive trust on trust property, or trace trust property wrongfully disposed of and recover the property or its proceeds; or\n(10) order any other appropriate relief, including relief under RSA 547:3-b.","path":["Title LVI: PROBATE COURTS AND DECEDENTS' ESTATES","Chapter ARTICLE 10: LIABILITY OF TRUSTEES AND RIGHTS OF PERSONS DEALING WITH TRUSTEE"],"source_url":"https://gc.nh.gov/rsa/html/LVI/564-B/564-B-10-1001.htm","current_through":"2025 regular legislative session, or December 2025","vintage":"","retrieved_at":"2026-09-05T17:07:35Z","sha256":"2b14b8f395d5717aea244ef1d7ee4ef19e9662b0e1f31c9a632fec9275b6836b","source_id":"us-nh","stale":false,"prev":"us-nh/rsa-564-b-9-907","next":"us-nh/rsa-564-b-10-1002"},"notice":"GroundRules: Original legal text.
