{"data":{"id":"us-nh/rsa-564-b-4-414","jurisdiction":"us-nh","citation":"RSA 564-B:4-414","heading":"Modification or Termination of Uneconomic Trust.","body":"(a) After notice to the qualified beneficiaries, the trustee of a trust consisting of trust property having a total value less than $100,000 may terminate the trust if:\n(1) The trustee concludes that the value of the trust property is insufficient to justify the cost of administration; and\n(2) Within 30 days after the notice was sent to the qualified beneficiaries, a beneficiary does not notify the trustee of the beneficiary's objection to the trust's termination.\n(b) The court may modify or terminate a trust or remove the trustee and appoint a different trustee if it determines that the value of the trust property is insufficient to justify the cost of administration.\n(c) Upon termination of a trust under this section, the trustee shall distribute the trust property in a manner consistent with the purposes of the trust.\n(d) This section does not apply to an easement for conservation or preservation or to a fund held or created by a town or other municipality under RSA 31:19 or RSA 31:19-a.","path":["Title LVI: PROBATE COURTS AND DECEDENTS' ESTATES","Chapter ARTICLE 4: CREATION, VALIDITY, MODIFICATION, AND TERMINATION OF TRUST"],"source_url":"https://gc.nh.gov/rsa/html/LVI/564-B/564-B-4-414.htm","current_through":"2025 regular legislative session, or December 2025","vintage":"","retrieved_at":"2026-09-05T17:07:35Z","sha256":"3fbac76786319f5c0b84af16e65faf2423441271c5e6b5b854dfc73ac03fb273","source_id":"us-nh","stale":false,"prev":"us-nh/rsa-564-b-4-413","next":"us-nh/rsa-564-b-4-415"},"notice":"GroundRules: Original legal text.
