{"data":{"id":"us-nh/rsa-564-b-5-505b","jurisdiction":"us-nh","citation":"RSA 564-B:5-505B","heading":"Coordination with Qualified Dispositions in Trusts.","body":"(a) On the effective date of RSA 564-B:5-505A, RSA 564-B:5-505A shall apply to:\n(1) Any transfer that:\n(A) Was made before the effective date of RSA 564-B:5-505A; and\n(B) Qualified as a qualified disposition within the meaning of RSA 564-D:1, VII, as in effect immediately before the effective date of RSA 564-B:5-505A; and\n(2) Any trust into which, before the effective date of RSA 564-B:5-505A, there was a transfer described in subsection (a)(1).\n(b) Except as otherwise permitted under RSA 564-B:5-505A, a creditor or assignee of a settlor may not avoid a transfer described in subsection (a)(1) if the creditor or assignee could not have avoided the transfer under RSA 564-D as in effect immediately before the effective date of RSA 564-B:5-505A.\n(c) Except as otherwise permitted under RSA 564-B:5-505A, a creditor or assignee of a settlor may not reach any property of a trust described in subsection (a)(2) if the creditor or assignee could not have reached the property under RSA 564-D as in effect immediately before the effective date of RSA 564-B:5-505A.","path":["Title LVI: PROBATE COURTS AND DECEDENTS' ESTATES","Chapter ARTICLE 5: CREDITOR'S CLAIMS; SPENDTHRIFT AND DISCRETIONARY TRUSTS"],"source_url":"https://gc.nh.gov/rsa/html/LVI/564-B/564-B-5-505B.htm","current_through":"2025 regular legislative session, or December 2025","vintage":"","retrieved_at":"2026-09-05T17:07:35Z","sha256":"3ee229b7b8afee8dab2f2ed177cf03994046eb2a6ec96cfbc98e0e2d3f352dc9","source_id":"us-nh","stale":false,"prev":"us-nh/rsa-564-b-5-505a","next":"us-nh/rsa-564-b-5-506"},"notice":"GroundRules: Original legal text.
