{"data":{"id":"us-nh/rsa-564-f-17-1703","jurisdiction":"us-nh","citation":"RSA 564-F:17-1703","heading":"Cy Pres.","body":"(a) To the extent that a foundation is a charitable trust and one of its charitable purposes becomes impossible, impracticable, illegal, obsolete, ineffective, or prejudicial to the public interest to achieve, a court may apply cy pres for the following purposes:\n(1) Modifying the foundation's certificate of formation or its bylaws; or\n(2) Directing the foundation to apply or distribute some or all of its property to one or more charitable purposes that:\n(A) Are useful to the community;\n(B) Fulfills as nearly as possible the founder's charitable intent; and\n(C) Do not violate any of the foundation's material purposes; or\n(3) Terminating the foundation.\n(b) Any of the following persons may commence a judicial proceeding seeking the application of cy pres to a foundation under this section:\n(1) A foundation official;\n(2) Unless the governing documents provide otherwise, a beneficiary; and\n(3) The director of charitable trusts.","path":["Title LVI: PROBATE COURTS AND DECEDENTS' ESTATES","Chapter ARTICLE 17: Modification"],"source_url":"https://gc.nh.gov/rsa/html/LVI/564-F/564-F-17-1703.htm","current_through":"2025 regular legislative session, or December 2025","vintage":"","retrieved_at":"2026-09-05T17:08:19Z","sha256":"beb162b2e8d22c158325a63f1dadc4f0347e5781247e8d0c0c46e462f1245683","source_id":"us-nh","stale":false,"prev":"us-nh/rsa-564-f-17-1702","next":"us-nh/rsa-564-f-18-1801"},"notice":"GroundRules: Original legal text.
