{"data":{"id":"us-nh/rsa-564-f-18-1809","jurisdiction":"us-nh","citation":"RSA 564-F:18-1809","heading":"Beneficiary's Consent, Release, or Ratification.","body":"(a) Subject to subsection (b), a foundation official is not liable to a beneficiary for breach of duty if the beneficiary:\n(1) Consented to the conduct constituting the breach of duty;\n(2) Released the foundation official from liability for the breach of duty; or\n(3) Ratified the transaction constituting the breach of duty.\n(b) For purposes of subsection (a), a beneficiary's consent, release, or ratification is invalid if:\n(1) In making the consent, release, or ratification, the beneficiary was induced by a foundation official's improper conduct; or\n(2) At the time of making the consent, release, or ratification, the beneficiary did not know of the beneficiary's rights or the material facts relating to the breach of duty.","path":["Title LVI: PROBATE COURTS AND DECEDENTS' ESTATES","Chapter ARTICLE 18: Breach of Duty"],"source_url":"https://gc.nh.gov/rsa/html/LVI/564-F/564-F-18-1809.htm","current_through":"2025 regular legislative session, or December 2025","vintage":"","retrieved_at":"2026-09-05T17:08:19Z","sha256":"53559b21ed72fab7f9cfae0a5b3e7e2688af203b3a775b1ccb2991f5cea7bdd7","source_id":"us-nh","stale":false,"prev":"us-nh/rsa-564-f-18-1808","next":"us-nh/rsa-564-f-19-1901"},"notice":"GroundRules: Original legal text.
