{"data":{"id":"us-nh/rsa-564-f-20-2013","jurisdiction":"us-nh","citation":"RSA 564-F:20-2013","heading":"Judicial Dissolution.","body":"(a) A court may dissolve a foundation if:\n(1) The foundation procured its certificate of formation through fraud, duress, or undue influence;\n(2) The foundation's purposes are not lawful or are contrary to the public policy of this state;\n(3) The foundation has exceeded or abused its lawful authority under this chapter;\n(4) The foundation has carried on, conducted, or transacted its affairs in a persistently fraudulent or illegal manner; or\n(5) The foundation has abused its power contrary to the public policy of this state.\n(b) A court may dissolve a foundation if:\n(1) All of the foundation officials consent to the termination;\n(2) All of the beneficiaries consent to the termination;\n(3) To the extent that the foundation is a charitable trust, the director of charitable trusts consents to the dissolution; and\n(4) The dissolution does not violate any of the foundation's material purposes.\n(c) A court may dissolve a foundation if:\n(1) Because of circumstances that the founder did not anticipate, the dissolution will further the foundation's purposes; and\n(2) The dissolution does not violate any of the foundation's material purposes.\n(d) Any of the following persons may commence a judicial proceeding seeking the foundation's dissolution under this section:\n(1) A foundation official;\n(2) A beneficiary unless the governing documents prohibit the beneficiary from commencing a judicial proceeding seeking the foundation's dissolution;\n(3) To the extent that the foundation is a charitable trust, the director of charitable trusts; and\n(4) With respect to a dissolution under subsection (a), the attorney general.","path":["Title LVI: PROBATE COURTS AND DECEDENTS' ESTATES","Chapter Part C: Judicial Dissolution"],"source_url":"https://gc.nh.gov/rsa/html/LVI/564-F/564-F-20-2013.htm","current_through":"2025 regular legislative session, or December 2025","vintage":"","retrieved_at":"2026-09-05T17:08:19Z","sha256":"a144eb161ac9233c5a5a073f9cd4d296d17154e5bf852c62f47f8613127930ca","source_id":"us-nh","stale":false,"prev":"us-nh/rsa-564-f-20-2012","next":"us-nh/rsa-564-f-21-2101"},"notice":"GroundRules: Original legal text.
