Except as provided in subsections b. and c. of this section, this act applies to electronic records and electronic signatures relating to a transaction.\nb.\tThis act does not apply to a transaction to the extent it is governed by a law governing the creation and execution of wills, codicils or testamentary trusts.\nc.\tThis act does not apply to:\n(1)\tcourt orders or notices or official court documents (including briefs, pleadings and other writings) required to be executed in connection with court proceedings;\n(2)\tany notice of:\n(a)\tthe cancellation or termination of utility services (including water, heat and power);\n(b)\tthe default, acceleration, repossession, foreclosure or eviction, or the right to cure, under a credit agreement secured by, or a rental agreement for, a primary residence of an individual;\n(c)\tthe cancellation or termination of health insurance benefits or life insurance benefits (excluding annuities); or\n(d)\tthe recall of a product, or material failure of a product, that risks endangering health or safety; or\n(3)\tany document required to accompany any transportation or handling of hazardous materials, pesticides or other toxic or dangerous materials.\nd.\tThis act applies to an electronic record or electronic signature otherwise excluded from the application of this act under subsection b. of this section to the extent it is governed by a law other than those specified in subsection b. of this section.\ne.\tA transaction subject to this act is subject also to other applicable substantive law.\nL.2001, c.116, s.3; amended 2021, c.179, s.36.","path":["TITLE 12A COMMERCIAL TRANSACTIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"5bc2a8725f6319a65271fd5a48e9a437d7638b227be125eac8d7f5b1a95efc49","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-12a-12-2","next":"us-nj/n.j.-stat.-12a-12-4"},"notice":"GroundRules: Original legal text.
