Stat. § 12A:9-301","heading":"Law governing perfection and priority of security interests.","body":"Law Governing Perfection and Priority of Security Interests.\nExcept as otherwise provided in sections 12A:9-303 through 12A:9-306, the following rules determine the law governing perfection, the effect of perfection or nonperfection, and the priority of a security interest in collateral:\n(1)\tExcept as otherwise provided in this section, while a debtor is located in a jurisdiction, the local law of that jurisdiction governs perfection, the effect of perfection or nonperfection, and the priority of a security interest in collateral.\n(2)\tWhile collateral is located in a jurisdiction, the local law of that jurisdiction governs perfection, the effect of perfection or nonperfection, and the priority of a possessory security interest in that collateral.\n(3)\tExcept as otherwise provided in paragraph (4), while tangible negotiable documents, goods, instruments, money, or tangible chattel paper is located in a jurisdiction, the local law of that jurisdiction governs:\n(A)\tperfection of a security interest in the goods by filing a fixture filing;\n(B)\tperfection of a security interest in timber to be cut; and\n(C)\tthe effect of perfection or nonperfection and the priority of a nonpossessory security interest in the collateral.\n(4)\tThe local law of the jurisdiction in which the wellhead or minehead is located governs perfection, the effect of perfection or nonperfection, and the priority of a security interest in as-extracted collateral.\n(5)\tNotwithstanding paragraph (1), the local law of this State shall govern the perfection, the effect of perfection or nonperfection, and the priority of a security interest in bondable transition property.\nL.2001, c.117, s.1; amended 2001, c.386, s.18; 2013, c.65, s.8.","path":["TITLE 12A COMMERCIAL TRANSACTIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"87ddd6f8a66f2fa874736acefa2c913ec5591d700a232e6e25320d73370bab5f","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-12a-9-210","next":"us-nj/n.j.-stat.-12a-9-302"},"notice":"GroundRules: Original legal text.
