Stat. § 13:1E-99.143","heading":"Adjustment of postconsumer recycled content requirements, authority.","body":"9.\ta.  Notwithstanding the provisions of this act to the contrary, the department may, pursuant to the \"Administrative Procedure Act,\" P.L.1968, c.410 (C.52:14B-1 et seq.), review and adjust any of the postconsumer recycled content requirements established in sections 3 through 8 of this act.  In making an adjustment pursuant to this section, the department shall consider:\n(1)\tchanges in market conditions, including supply and demand for postconsumer recycled content, collection rates, and bale availability both domestically and globally;\n(2)\trecycling rates, as may be determined by the department;\n(3)\tthe availability of recycled material suitable for manufacturers to meet the postconsumer recycled content requirements, including the availability of high-quality recycled plastic or glass, and food-grade recycled plastic or glass;\n(4)\tthe capacity of recycling or processing infrastructure;\n(5)\tthe progress made by manufacturers in meeting the postconsumer recycled content requirements; and\n(6)\tany other factors as determined by the department pursuant to rule, regulation, or guidance.\nb.\tAny adjustment to the postconsumer recycled content requirements made pursuant to this section shall be only for a time-period, and only under such conditions, as the department may by rule or regulation establish.\nL.2021, c.391, s.9.","path":["TITLE 13 CONSERVATION AND DEVELOPMENT--PARKS AND RESERVATIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"771c7b10fbc7d5ef990ac79d9fafa07fecff6a314df2b63e266a771dc436f708","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-13-1e-99.142","next":"us-nj/n.j.-stat.-13-1e-99.144"},"notice":"GroundRules: Original legal text.
