Stat. § 13:9B-11","heading":"Determination of public interest","body":"In determining whether a proposed regulated activity in any freshwater wetland is in the public interest, the department shall consider the following:\na.   the public interest in preservation of natural resources and the interest of the property owners in reasonable economic development;\nb.   the relative extent of the public and private need for the proposed regulated activity;\nc.   where there are unresolved conflicts as to resource use, the practicability of using reasonable alternative locations and methods, including mitigation, to accomplish the purpose of the proposed regulated activity;\nd.   the extent and permanence of the beneficial or detrimental effects which the proposed regulated activity may have on the public and private uses for which the property is suited;\ne.   the quality of the wetland which may be affected and the amount of freshwater wetlands to be disturbed;\nf.   the economic value, both public and private, of the proposed regulated activity to the general area; and\ng.   the ecological value of the freshwater wetlands and probable impact on public health and fish and wildlife.\nL. 1987, c. 156, s. 11.","path":["TITLE 13 CONSERVATION AND DEVELOPMENT--PARKS AND RESERVATIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"01116b7eafe0708ecbda2f1bc970bd9480ffe4e53f74c8c12c407bef9815da77","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-13-9b-10","next":"us-nj/n.j.-stat.-13-9b-12"},"notice":"GroundRules: Original legal text.
