Except as provided in subsection b. of this section, each prepaid prescription service organization shall, at all times, have and maintain tangible net equity equal to the greater of:\n(1) \t$50,000; or\n(2)\t2% of the organization's annual gross premium income, up to a maximum of the required capital and surplus of an admitted health insurer.\nb.\tAn organization which has uncovered expenses in excess of $50,000, as reported on the most recent annual financial statement filed with the commissioner, shall maintain tangible net equity equal to 25% of the uncovered expense in excess of $50,000, in addition to the tangible net equity required by subsection a. of this section.\nc.\tThe dollar amounts specified in subsections a. and b. of this section shall be adjusted annually by the commissioner, by regulation, in accordance with changes in the Consumer Price Index.\nL.1997,c.380,s.14.","path":["TITLE 17 CORPORATIONS AND INSTITUTIONS FOR FINANCE \t\t\tAND INSURANCE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"30e37e4b743c4f27d9207791e5a8fe1816da6f6ca96e8546f1a9a278cbd8a722","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-17-48f-13.2","next":"us-nj/n.j.-stat.-17-48f-15"},"notice":"GroundRules: Original legal text.
