Stat. § 17B:27A-7.26","heading":"Individual health benefits plan to meet essential health benefits requirements.","body":"1. a. An individual health benefits plan subject to P.L.1992, c.161 (C.17B:27A-2 et seq.) shall provide coverage under every plan delivered, issued, executed or renewed in this State, on or after the effective date of this act, that meets the essential health benefits requirements provided by this section.\nb.\tPursuant to section 3 of P.L.2019, c.354 (C.17B:27A-60), the commissioner shall define essential health benefits to include at least the following general categories and the items and services covered within the categories:\n(1)\tambulatory patient services;\n(2)\temergency services;\n(3)\thospitalization;\n(4)\tmaternity and newborn care;\n(5)\tmental health and substance use disorder services, including behavioral health treatment;\n(6)\tprescription drugs;\n(7)\trehabilitative and habilitative services and devices;\n(8)\tlaboratory services;\n(9)\tpreventive and wellness services and chronic disease management; and\n(10) pediatric services, including oral and vision care.\nc.\tAn individual health benefits plan shall provide for a level of coverage that is designed to provide benefits that are actuarially equivalent to:\n(1)\t60 percent of the full actuarial value of the benefits provided under the plan;\n(2)\t70 percent of the full actuarial value of the benefits provided under the plan; or\n(3)\t80 percent of the full actuarial value of the benefits provided under the plan.\nd.\tThe level of coverage of a plan shall be determined on the basis that the essential health benefits described in subsection b. of this section are provided to a standard population, and without regard to the actual population to which the plan may provide benefits.\ne.\tThe commissioner shall develop guidelines to provide for a de minimis variation in the actuarial calculations used in determining the level of coverage of a plan to account for differences in actuarial estimates.\nL.2019, c.354, s.1.","path":["TITLE 17B INSURANCE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"cd7dedfa528264b3934b8b9c27bcf689c67e50b373ca93cd511f2c0e7f9ca5b6","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-17b-27a-7.25","next":"us-nj/n.j.-stat.-17b-27a-7.27"},"notice":"GroundRules: Original legal text.
