A non-resident student enrolled at a charter school shall meet the following requirements to participate in interscholastic athletics at the school:\n(1)\tthe student shall reside within a 20-mile radius of the charter school;\n(2)\tif the student initially enrolls in the charter school in grade 11, the student shall not participate in interscholastic athletics for one year following the date of enrollment; and\n(3)\tif the student initially enrolls in the charter school in grade 12, the student shall not participate in interscholastic athletics.\nb.\tThe commissioner may authorize a waiver of the provisions of subsection a. of this section if the school district of residence of the non-resident student does not offer the interscholastic athletic activity in which the non-resident student participates.\nc.\tThe provisions of subsection a. of this section shall not apply to any student enrolled in a charter school on the effective date of P.L.2025, c.276 (C.18A:36A-3.1 et al.).\nL.2025, c.276, s.9.","path":["TITLE 18A EDUCATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"dab9ab7344e02264849cb9068cea7eb66b882fba947ba20db9cbe47effe0eaf4","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-18a-36a-8","next":"us-nj/n.j.-stat.-18a-36a-9"},"notice":"GroundRules: Original legal text.
