Stat. § 18A:38-8.1","heading":"Representation of board of education of sending district; matters covered.","body":"1.\tIn addition to the members of the board of education of a Type I and Type II school district provided by law, in a school district which is receiving pupils from another district or districts pursuant to N.J.S.18A:38-8, there shall be an additional member as provided pursuant to section 2 of this act to represent the board of education of each sending district.  Any additional member shall be a member of the board of education of a sending district designated annually by the board of that district and shall be eligible to vote on the following matters before the receiving district board of education:\na.\tTuition to be charged the sending district by the receiving district and the bill lists or contracts for the purchase, operation or maintenance of facilities, equipment and instructional materials to be used in the education of the pupils of the sending district;\nb.\tNew capital construction to be utilized by sending district pupils;\nc.\tAppointment, transfer or removal of teaching staff members providing services to pupils of the sending district, including any teaching staff member who is a member of the receiving district's central administrative staff;\nd.\tAddition or deletion of curricular and extracurricular programs involving pupils of the sending district;\ne.\tAny matter directly involving the sending district pupils or programs and services utilized by those pupils;\nf.\tApproval of the annual receiving district budget;\ng.\tAny collectively negotiated agreement involving employees who provide services utilized by sending district pupils;\nh.\tAny individual employee contracts not covered by a collectively negotiated agreement, if those employees provide or oversee programs or services utilized by sending district pupils; and\ni.\tAny matter concerning governance of the receiving district board of education including, but not limited to, the selection of the board president or vice-president, approval of board bylaws, and the employment of professionals or consultants such as attorneys, architects, engineers, or others who provide services to the receiving district board of education.\nL.1995, c.8, s.1; amended 1996, c.103; 2017, c.140.","path":["TITLE 18A EDUCATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"f0574df305ae96a21018782acc1f3ac2b233bfa03c7368be8b08281e1535d22d","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-18a-38-8","next":"us-nj/n.j.-stat.-18a-38-8.2"},"notice":"GroundRules: Original legal text.
