The Secretary of Higher Education shall approve an institution of higher education or a proprietary institution licensed to offer academic degrees to act as an eligible transfer institution if the institution:\n(1)\tis in good standing with its accreditor and, if applicable, its licensing body;\n(2)\tif applicable, has not been sanctioned by the United States Department of Education due to having a high cohort loan default rate;\n(3)\thas not been placed on Heightened Cash Monitoring Payment Method Level 2 by the United States Department of Education;\n(4)\twithin the previous five years has not had any judgments related to a consumer protection law entered against it in favor of a law enforcement agency; and\n(5)\tmeets the requirements provided in section 9 of P.L.2021, c.27 (C.18A:3B-93), and any additional standards provided pursuant to subsection b. of this section.\nb.\tThe secretary may establish additional standards on a case-by-case basis for approving an eligible transfer institution.\nL.2021, c.27, s.10.","path":["TITLE 18A EDUCATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"f97aa00ae0687f7121ca6fb569e0c34d18f751a5da88938febe489754bee3b0a","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-18a-3b-93","next":"us-nj/n.j.-stat.-18a-3b-95"},"notice":"GroundRules: Original legal text.
