Stat. § 18A:40A-24","heading":"Public hearing prior to adoption of drug testing policy.","body":"3.\tEach board of education shall hold a public hearing prior to the adoption of its drug testing policy.  The policy shall be in written form and shall be distributed to students and their parents or guardians at the beginning of each school year.  The policy shall include, but need not be limited to, the following:\na.\tnotice that the consent of the student and his parent or guardian for random student drug testing is required for the student to participate in extracurricular activities and to possess a school parking permit;\nb.\tthe procedures for collecting and testing specimens;\nc.\tthe manner in which students shall be randomly selected for drug testing;\nd.\tthe procedures for a student or his parent or guardian to challenge a positive test result;\ne.\tthe standards for ensuring the confidentiality of test results;\nf.\tthe specific disciplinary action to be imposed upon a student who tests positive for drug use or refuses to consent to testing;\ng.\tthe guidelines for the referral of  a student who tests positive for drug use to drug counseling or rehabilitative treatment; and\nh.\tthe scope of authorized disclosure of test results\nL.2005,c.209,s.3.","path":["TITLE 18A EDUCATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"8098e7a22186b26add9a50342218e67670cae1e7e3c55493231bc09e7ae618d1","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-18a-40a-23","next":"us-nj/n.j.-stat.-18a-40a-25"},"notice":"GroundRules: Original legal text.
