A dependent student shall be considered domiciled in this State for the purposes of determining eligibility for a State student grant or scholarship if the student meets the following criteria:\n(1)\tthe student is a United States citizen or an eligible noncitizen, as determined under 20 U.S.C. s.1091;\n(2)\tthe student and the student's parent have resided in the State for a period of not less than 12 consecutive months immediately prior to the academic period for which State student assistance is being requested; and\n(3)\tthe student's parent or guardian provides the Higher Education Student Assistance Authority, upon request, with documentation to verify income and assets.\nb.\tAny procedures and forms established by the Higher Education Student Assistance Authority and the Secretary of Higher Education for the purposes of this section shall not discriminate against eligible students based on the immigration status or national origin of the student or the student's parent or guardian.\nc.\tNothing in this section shall be construed to affect the eligibility for a State student grant or scholarship of any student who does not meet the requirements of this section but is otherwise eligible for State student assistance in accordance with law or regulation.\nL.2019, c.383, s.2.","path":["TITLE 18A EDUCATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"65bad7d6cc59953f6595f97ce0eff6b12ac5fc170bfb71e916bb38fb5dd1f546","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-18a-71b-2.2","next":"us-nj/n.j.-stat.-18a-71b-2.4"},"notice":"GroundRules: Original legal text.
