Any parent or guardian of a pupil in a State facility and any pupil in a State facility between 18 and 20 years of age, may request an administrative review on matters of educational classification or educational program.\nb.\tThe administrative review process shall include the following sequence:\n(1)\tA conference with teaching staff members or child study team personnel;\n(2)\tA conference with the Director of Educational Services of the Department of Human Services, the Department of Children and Families, the Department of Corrections, or the Youth Justice Commission, whichever is appropriate;\n(3)\tA hearing by the Commissioner of Education pursuant to law and regulation.\nc.\tThe due process rights available to children, parents and guardians in the public schools on matters of educational classification or educational program shall be available to children, parents and guardians in State facilities.\nd.\tThe placement of a child in a particular State facility shall not be subject to an administrative review or hearing pursuant to this section.\nL.1979, c.207, s.11; amended 1996, c.138, s.43; 2006, c.47, s.83; 2025, c.35, s.32.","path":["TITLE 18A EDUCATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"3ea23a8d7be6ab2969a0eb87f43b1e18537158ee04b2738d7097dacfbbb72dc0","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-18a-7b-6","next":"us-nj/n.j.-stat.-18a-7b-8"},"notice":"GroundRules: Original legal text.
