From the fees set forth in section 14 of P.L.1991, c.177 (C.22A:2-37.1), the clerk of the Special Civil Part of the Superior Court, Law Division, shall pay to officers designated by the Assignment Judge to serve process the following fees:\n(1)\tServing summons, notice or\nthird party complaint on one defendant\t\t\t$  3.00\non every additional defendant\t\t\t\t$  2.00\n(2)\tReserving summons or other\noriginal process on any defendant\t\t\t$  3.00\n(3)\tWarrant to arrest, capias, or\ncommitment, for each defendant served\t\t\t$15.00\n(4)\tServing writ and summons in\nreplevin, taking bond and any inventory, against\none defendant\t\t\t\t\t\t$  6.00\non every additional defendant\t\t\t\t$  2.00\n(5)\tServing writ in replevin when\nissued subsequent to service of summons,\nagainst one defendant\t\t\t\t\t$  5.00\non every additional defendant\t\t\t\t$  2.00\n(6)\tServing order for possession\nin replevin\t\t\t\t\t\t$  4.00\n(7)\tServing writ of attachment and\nmaking inventory, one defendant\t\t\t$  4.00\non every additional defendant\t\t\t\t$  2.00\n(8)\tServing and executing warrant\nfor possession in tenancy\t\t\t\t$10.00\n(9)\tEvery execution, or any order in\nthe nature of an  execution, on a judgment, for\neach defendant\t\t\t\t\t\t$  2.00\nb.\tFor serving or executing any process, writ,\norder, execution, notice or warrant\t\t\t$  7.00\nc.\tIn addition to the foregoing, the following fees for officers of the Special Civil Part shall be taxed in the costs and collected on execution, writ of attachment or order in the nature of any execution on any final judgment, or on a valid and subsisting levy of an execution or attachment which may be the effective cause in producing payment or settlement of a judgment or attachment:\n(1)\tFor advertising property\nunder execution or any order\t\t\t\t$10.00\n(2)\tFor selling property under\nexecution or any order\t\t\t\t\t$10.00\n(3)\tOn every dollar collected on\nexecution, writ of attachment, or any order,\t\t$  0.10.\n(4)\tIn the event a judgment is vacated for any reason after a court officer has made a levy and thereafter the judgment is reinstated or the case is settled, the dollarage due the court officer on payment of the judgment amount or settlement amount again shall be taxed in the costs and collected.\nd.\tIn addition to the foregoing, the clerk of the Special Civil Part shall pay to officers designated by the Assignment Judge to serve wage executions on a federal agency an amount equal to the fee set by either the Administrative Director of the Courts pursuant to paragraph (5) of subsection a. of section 14 of P.L.1991, c.177 (C.22A:2-37.1) or set pursuant to subsection d. of that section, whichever then may be applicable, for each wage execution served.\nL.1991, c.177, s.15; amended 2000, c.129, s.2; 2001, c.275; 2003, c.259, s.2; 2021, c.188, s.9.","path":["TITLE 22A FEES AND COSTS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"289d4dee12737c06e83b11aa6c13286870463446170d0aeadfd9c31b1e4a3e32","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-22a-2-37.1","next":"us-nj/n.j.-stat.-22a-2-41"},"notice":"GroundRules: Original legal text.
